Artificial Intelligence Use Notice

1. What this notice is for

Faro is a product that uses artificial intelligence in a central, not incidental, manner. Out of honesty with those who use us, this notice explains in clear language how and where artificial intelligence intervenes in Faro, what data of yours is sent to third-party AI model providers, what decisions are made in an automated manner and where a person intervenes, what we guarantee to you and what we cannot guarantee to you, and what rights you have with respect to all of this.

This notice supplements, and does not replace, the Privacy Policy and Personal Data Processing Policy, the Personal Data Processing Policy, the Terms and Conditions and the Cookie Policy of Faro. In the event of any doubt regarding the Processing of your personal data, those documents and the applicable law govern; this notice exists so that you understand, without technicalities, the role of artificial intelligence.

This notice applies to the two surfaces of Faro:

1. holafaro.com, the Faro website and the free visibility diagnostic, which measures whether artificial intelligence systems read and cite you.
2. app.holafaro.com, the Faro platform, with invitation-only access, where Faro builds and publishes your professional presence in a form legible by artificial intelligence.

2. What we mean when we say “artificial intelligence”

In this notice, “artificial intelligence” or “AI models” refers to third-party systems known as large language models, such as those that operate common artificial intelligence assistants (for example, ChatGPT), and to search-results analysis services. Faro does not manufacture these models: it queries them. The providers of those models are third parties independent of Faro, with their own terms of use and data processing, and are located mainly outside Colombia, in the United States of America. The detail of these providers is in Section 8.

3. The free diagnostic queries artificial intelligence using the data you provide

When you run the free diagnostic on holafaro.com, the very purpose of the service is to measure how artificial intelligence systems read and cite you. To achieve this, Faro necessarily asks those systems about you.

This means, concretely, that:

1. With the data you enter in the form (mainly your name or brand, your professional category or topic and your location, and optionally your domain, declared networks and competitors), Faro builds questions and sends them to the application programming interfaces (API) of several third-party AI model providers and to a search-results analysis provider.

2. Those providers process the question on their own servers, located mainly in the United States, and return a response about you: whether they mention you, in what position, with what accuracy and with what sentiment.

3. Faro gathers those responses, rates them and produces your report, which includes the Faro Index (a rating from 0 to 100) and its dimensions (presence, recognition, fidelity, consistency and citation), together with the landscape of your presence in search engines.

This sending of data to third parties is inherent to the service: it is not technically possible to measure whether artificial intelligence cites you without asking artificial intelligence about you. For this reason, running the diagnostic implies and requires this transmission of your data to the providers indicated in Section 8. If you do not wish your data to be transmitted to those providers, the way forward is not to run the diagnostic.

4. The platform uses artificial intelligence to infer a representation of your identity and to compose your website

On the platform app.holafaro.com, Faro works under a regime we call inferential: on the basis of the material you provide (your résumé, biographies, professional documents) and the interview conversation you hold with the system (a text conversation, not voice), Faro infers a structured representation of your professional identity. That is, Faro does not merely copy what you write: it interprets that material to build a map of who you are professionally, what you do and what distinguishes you, and with that map it composes the texts and the website that will represent you.

To do so, Faro sends your material and your conversations to a third-party AI model provider, which processes that content on its servers, located in the United States, and returns the identity extraction and the drafted pieces. Section 8 details the category of this provider and the applicable safeguards.

It is important that you understand the nature of this:

• The representation of your identity is an inference, not an official fact. It may contain errors, omissions or interpretations that you do not share.
• Nothing that Faro infers or composes is definitive without you. Before anything is published or taken as true, you review it and confirm it (see Section 6).
• You retain at all times the right to correct a fact, mark an inference as disputed, or delete your material (see Section 9).

5. The website that Faro publishes is legible by artificial intelligence by design

The central product of the platform is to publish, at a public address (a URL under app.holafaro.com), a website that represents your professional presence, accompanied by a technical file called llms.txt. That file and the structure of the website exist for an explicit purpose: so that artificial intelligence systems and search engines can read, understand and cite your information with ease. That is what Faro does for you.

For this reason you must understand and accept the following before publishing:

1. Publishing makes public. What you mark as public (your name, your biography, the facts you decide to show) ceases to be private and becomes accessible to anyone on the internet.

2. What is public becomes indexable and citable. Once published, that content may be indexed by search engines and read, processed and cited by third-party artificial intelligence systems. That is the intended result of the service, not a side effect.

3. You control what is published. On the platform, each fact has a visibility (private or public) that you manage as an explicit act, with confirmation. Nothing is made public without your action.

4. Withdrawing the website does not delete third-party copies. If you unpublish or delete your website, we stop displaying it from Faro, but we cannot guarantee that the copies, caches, indexes or extracts that search engines, artificial intelligence systems or other third parties may already have taken on their own account while the website was public will be deleted. That is beyond our control.

6. Automated decisions and where a person or your confirmation intervenes

Faro automates analysis and drafting tasks, but is designed under a principle: the system works and the owner of the data confirms. Below we clarify what is automated and where there is human supervision or confirmation.

It is automated (done by the system, with AI or with rules):

• The calculation of the Faro Index and its dimensions from the models’ responses.
• The querying of the artificial intelligence models and the search engines.
• The verification of the email by means of a security code, and the anti-abuse controls (for example, limits by IP address), which are automatic technical controls of security, availability and cost.
• The identity extraction and the composition of texts and of the website on the platform.

You or a person intervenes (supervision and confirmation):

• On the platform, you review and confirm the facts and the content before they are taken as true or published. The publication of a fact or of your website is an explicit act of yours.
• You may correct any fact, mark as disputed an inference, and object to or request the review of an automated result by writing to faro@navigamo.co.

On automated decisions with legal effects. The diagnostic and the representation that Faro composes are informative and indicative. Faro does not use them to make decisions on your behalf that produce legal effects on you or that similarly significantly affect you (for example, it does not decide on credit, employment, hiring or access to services). If in the future any Processing were to involve a decision of that kind based solely on automated means, we would inform you specifically and you would have the right to request human intervention, to express your point of view and to challenge the decision, in the terms of the applicable law (including Article 22 of the General Data Protection Regulation for visitors from the European Union).

7. What Faro does not guarantee to you

Faro is honest about the limit of what it can promise. The results of artificial intelligence depend on third parties that Faro does not control. Therefore:

1. Faro does not guarantee that any artificial intelligence system will cite, mention or read you. Whether a model cites you, how it cites you and when it cites you depends on decisions of the model’s provider, on its training data, on its internal rules and on factors beyond Faro’s reach.

2. The results vary and may change without notice. The responses of the same model may vary from one query to another, and the providers update their models on their own account. A result of today is not a promise of the result of tomorrow.

3. Artificial intelligence models make mistakes. They may state things that are inaccurate, incomplete or outdated about you. Faro reports what the models say; it is not responsible for the truthfulness of what a third party states about you.

What Faro does offer, and the honest commitment of this product, is to stop being illegible: to structure and publish your presence in a way that artificial intelligence systems can read and understand. That is what is in our hands. Citation is not.

8. What data is sent to artificial intelligence providers and with what safeguards

To provide the service, Faro shares data with technology providers that act as Data Processors or recipients and that are located, for the most part, in the United States, which entails an international transfer of data from Colombia (and, for visitors from the European Union, from the European Economic Area). Below, the providers relevant to the use of artificial intelligence and what they receive:

The artificial intelligence model providers that actually receive your data depend on the operational configuration in force. The named list of sub-processors is available upon written request at faro@navigamo.co.

Safeguards. Faro applies, among others, the following measures with respect to this Processing:

• Data minimization. When querying the models, Faro sends what is necessary for the measurement or the composition (for example, name or brand, topic and location), not the entirety of your information. In the public view of the diagnostic report, your email address is not shown.
• Use through enterprise application programming interfaces (API), not the consumer versions of the assistants. The responsible attorney shall confirm, with each provider, the terms governing the use of the data sent by API, including the instruction that the data not be used to train models where the provider offers it, and the applicable international transfer mechanism.
• Encryption and access control. The data of your account and your files are stored in private storage with access control by user; the files are delivered only by temporary links; the third-party credentials that you connect (for example, the read-only access to your Google metrics) are stored encrypted.

The complete detail of all Data Processors and of the bases and guarantees of the international transfer is in the Privacy Policy and Personal Data Processing Policy and in the Personal Data Processing Policy of Faro.

9. Your rights with respect to Processing with artificial intelligence

You, as the Data Subject of your personal data, have the right to intervene in this Processing. In particular:

1. Review. To know what data of yours we hold, what representation Faro inferred and what was sent to the artificial intelligence providers. On the platform, in addition, you may export your data in a file (portability).

2. Correct. To rectify any inaccurate data and to correct or mark as disputed any inference that Faro has made about you.

3. Object and request human review. To object to a Processing where the law permits it, and to request the intervention of a person to review a result produced in an automated manner.

4. Delete. To request the deletion of your data and, on the platform, to erase your material. Please note the warning in Section 5: withdrawing a published website does not oblige third parties to delete copies they may already have taken. For accounting and accountability reasons, Faro may retain a minimum record of what has been deleted; the scope and the term of that retention are detailed in the Personal Data Processing Policy.

5. Revoke the consent you have granted, where the Processing is based on your consent, without retroactive effect.

To exercise any of these rights, write to faro@navigamo.co. We will address your request in the terms and periods established by the applicable law (Law 1581 of 2012 and Decree 1377 of 2013 in Colombia; the General Data Protection Regulation for Data Subjects in the European Union; and the California Consumer Privacy Act and its amendment, the CPRA, for residents of California). If you consider that your rights were not addressed, you may resort to the competent data protection authority; in Colombia, the Superintendence of Industry and Commerce.

10. Data you provide about third parties and sensitive data

Faro does not ask you for sensitive data (such as that relating to health, ethnic or racial origin, sexual orientation, beliefs, political opinions, biometric data or trade union affiliation). Nevertheless, the material that you upload and what you write in the interview are free text and are sent to artificial intelligence providers for processing. For this reason:

• Do not provide sensitive data in your material or in the interview, unless you deliberately decide to make it a public part of your professional presence. If you do so, we understand that you give your explicit consent to process it for that purpose.
• If you provide third-party data (for example, competitors’ names, or the name of another person to run a diagnostic on them), you declare that you have a legitimate basis to do so and that you assume responsibility toward that person for having provided their data.

11. Changes to this notice

Faro may update this notice when its artificial intelligence providers, the purposes or the applicable law change. The version in force will always be the one published on holafaro.com with its “Last updated” date. Substantial changes will be communicated through the usual channels of the product.
